On November 11, 2019, the Shoreacres City Council passed Resolution 2019-358 restructuring the Board of Adjustments.

Sec. 50-31. – Created; membership. 

There is created a board of adjustments commission. There shall be five members and up to 3 alternates

Sec. 50-32. – Terms of office. 

The members and alternates of the board of adjustments commission shall be appointed to serve for two-year terms.  

Positions 1, 2, and 3 shall be for a period to end July 31, 2021. Positions 4 and 5 shall end July 31, 2020. Subsequent appointments shall be for two- year terms with positions 1, 2 and 3 ending July 31 of odd-numbered years and positions 4 and 5 ending July 31 of even-numbered years. Terms for alternates shall coincide with Positions 1, 2, and 3. 

Sec. 50-36. – Appointment of members to the board of adjustments commission. 

The mayor shall have the authority to nominate members and alternates of the board of adjustments commission upon expiration of the above terms and to fill unexpired terms of any member who resigns or who no longer meets the qualifications of office. The city council shall ratify those nominations. Such nomination and ratifications shall be made during a regular council meeting. Whenever any member of said commission shall move from Shoreacres, his/her membership on said commission shall terminate automatically, without prejudice. Members and alternates of the commission may be removed by the city council after a public hearing and for cause documented in writing. The members shall serve with no compensation. 

Sec. 50-37. – Election of officers and procedures. 

The board of adjustments commission shall, at the call of the mayor, meet within 30 days to elect a chairman, vice-chairman and secretary and to establish rules of procedure. 

Sec. 50-38. – Duties of board of adjustments commission. 

The duties of the board of adjustments commission shall include: 

  1. Hear and decide an appeal that alleges error in an order, requirement, decision, or determination made by an administrative official in the enforcement of a city ordinance; 
  2. Hear and decide special exceptions to the terms of a zoning ordinance when the zoning ordinance requires the commission to do so; 
  3. Authorize in special cases a variance from the terms of a zoning ordinance; 
  4. Hear and decide other matters authorized by ordinance or state law.

Sec. 50-39. – Meetings and minutes. 

The board of adjustments commission shall hold meetings as needed to address current issues. Minutes of those proceedings shall be taken, approved, and preserved by the commission. Notice of the time and place of said meetings shall be posted by the office of the city secretary. Any interested person may attend such meetings. 

Sec. 50-40. – Qualifications. 

The appointed members must be resident citizens, living within the city limits, and qualified voters of the city for at least the previous six-month period before being appointed to the commission. 

Sec. 50-41. – Election of officers and procedures. 

The board of adjustments commission shall elect a chairman and vice-chairman from its membership. 

Sec. 50-42. – Quorum required.

A quorum shall consist of three members and/or alternates of the commission. No votes shall be taken without a quorum of the commission present.
